Beisl Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and Timmo Caspar Achsel, a sole proprietor based in Stockholm, Sweden (“Beisl”, “we”, “us”, or “our”). They govern your use of the Beisl iOS application, the website at beisl.pub, the Beisl API, and any related features that we make available (together, the “Service”).
Please read these Terms carefully. By creating a Beisl account, by signing in with Apple, or by otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
If you are accessing the Beisl iOS app from Apple's App Store, the Apple Media Services Terms and Conditions and the Licensed Application End User License Agreement (the “Apple EULA”) also apply. Section 14 below contains terms specific to the Apple distribution channel.
1. Who we are

Beisl is currently operated as a sole proprietorship under Swedish law. References in these Terms to “Beisl” mean the foregoing person, and any successor entity to which the Service may be transferred.
2. What Beisl is
Beisl is a social pub-crawl planner for iOS. You can:
- search for and add bars;
- rate bars on a fixed set of eight criteria, with optional notes and a drink-kind label;
- log visits to bars and build a personal logbook of nights out;
- create crawls (an ordered, scheduled sequence of stops), invite friends, and run them in real time, with optional automatic arrival detection through geofences and an optional live-position map for the crew;
- maintain a try-list and (with Premium) custom bar lists;
- manage friend relationships, including blocking; and
- subscribe to Beisl Premium, which currently unlocks larger crews and additional bar lists.
The Service is provided online and updates over time. Features may be added, changed, or removed; some features may be available only in some regions, on some device versions, or only to Premium subscribers.
3. Eligibility
To use Beisl you must:
- be at least the legal drinking age in your jurisdiction, and in any case at least 18 years old;
- have the legal capacity to enter into a binding contract;
- not be prohibited from using the Service under any applicable law (including export-control or sanctions laws); and
- not be a person whose account we have previously terminated for breach of these Terms.
By using Beisl you confirm that you meet these requirements. We may refuse service, close accounts, and remove or change content at our discretion to comply with these Terms or applicable law.
4. Your account
4.1 Sign in with Apple
Accounts are created exclusively through Sign in with Apple. Your Apple ID controls access to the Service, and you are responsible for keeping that Apple ID secure (including any device passcode, Face ID, or Touch ID). You must promptly notify us at hello@beisl.pub if you suspect any unauthorised use of your Beisl account.
4.2 Accuracy and honesty
The information you provide to Beisl — for example, your handle, display name, bar entries, ratings, notes, and reports — must not be intentionally false, misleading, fraudulent, or impersonate another person. You are responsible for the accuracy of what you submit.
4.3 One account per person
Each person may operate one Beisl account. You must not transfer your account to another person, sell it, share its credentials, or grant another person standing access to it.
5. Acceptable use
When using the Service, you agree that you will not:
- use the Service for any unlawful purpose, or in violation of any applicable national, regional, federal, state, or municipal law (including alcohol-licensing laws and laws against drink-driving);
- post, upload, or transmit content (including a bar entry, a handle, a display name, a note, a logbook caption, a list name, a report, or any other text) that is unlawful, defamatory, obscene, hateful, harassing, threatening, sexually explicit, fraudulent, or that infringes the rights of any third party;
- impersonate any person or entity, or misrepresent your affiliation with a person or entity;
- interfere with, disrupt, or attempt to gain unauthorised access to the Service, our servers, our networks, or the accounts or devices of other users (including by reverse-engineering the API, scraping data beyond what the app exposes, or running automated requests that exceed reasonable rate limits);
- use the Service to send spam, advertising, chain letters, pyramid schemes, or any unsolicited commercial communication;
- use the Service to track another person without their consent, or to facilitate stalking, harassment, or domestic abuse — Beisl is built around consensual, opt-in location sharing inside a crawl, and that is the only kind of location sharing we permit;
- use the Service to encourage minors to consume alcohol, or to organise activity that is illegal under the law of the place where it would happen;
- bypass or attempt to bypass any access restriction, billing system, content filter, or moderation tool;
- create fake bar entries, fake ratings, fake reports, or otherwise pollute the dataset;
- use the Service in connection with the development, training, fine-tuning, or evaluation of a machine-learning model without our written permission, including by scraping bar names, ratings, or other content for training data;
- remove or modify any copyright, trademark, or other proprietary notice from the Service; or
- use the Service in any manner that could damage, disable, overburden, or impair it, or that could harm Beisl or other users.
We reserve the right to investigate and take action against anyone we reasonably believe is violating this Section 5, including by issuing a warning, restricting features (e.g. hiding your bars or your ratings, removing your friend connections), suspending your account, or terminating it permanently. Repeat offenders will be removed.
6. Your content
6.1 You keep ownership
You retain all ownership rights you have in the content you create through the Service — your bar entries, ratings, notes, visits, crawls, lists, logbook captions, reports, handle, display name, and any other text or data you submit (your “User Content”).
6.2 Licence you grant Beisl
To run the Service, we need permission to host, store, transmit, format, and display your User Content. By submitting User Content you grant Beisl a worldwide, non-exclusive, royalty-free, sublicensable (only to our service providers acting on our behalf), transferable (only as part of a corporate transaction described in our Privacy Policy) licence to use, reproduce, store, modify (only for technical reformatting, e.g. resizing, transcoding, or renaming bars to deduplicate them), display, and distribute that User Content solely for the purpose of operating, providing, and improving the Service in line with our Privacy Policy. The licence ends when you delete the User Content or when you delete your account, except (a) for content that has been shared with other users and that they have not deleted from their copies, (b) to the extent we are required to retain the content by law, and (c) for the limited anonymisation we apply to bar entries and crawls created by deleted users so the venue and crawl history of other users keeps working.
6.3 No obligation to host
We may refuse to host User Content, take it down, or restrict its visibility, at our discretion, where we reasonably believe it violates these Terms or applicable law, or where we receive a complaint from another user or rightsholder. We do not pre-screen User Content.
6.4 Reporting and moderation
You can report a bar entry or another user from inside the app. A report sends us a target identifier and a free-text reason of up to 500 characters. We review reports and may, at our discretion, hide bars (so they no longer appear in search), delete bars, restrict features for a user, or terminate accounts. We are a small operation; we cannot guarantee that every report will be reviewed within any specific time, but we take reports about safety, harassment, illegal activity, and intellectual-property infringement seriously.
6.5 Intellectual-property complaints
If you believe that User Content on Beisl infringes your intellectual-property rights, please send a written notice to hello@beisl.pub including: (i) your contact details and an electronic or physical signature; (ii) identification of the work claimed to be infringed; (iii) identification of the allegedly infringing content (a sufficient description so we can locate it); (iv) a statement that you have a good-faith belief that the use is not authorised; and (v) a statement under penalty of perjury (where applicable in your jurisdiction) that the information in your notice is accurate and that you are authorised to act for the rightsholder. We may forward your notice to the user who posted the content.
7. Beisl Premium and other paid features
7.1 Subscription model
Beisl Premium is sold as an auto-renewing subscription through the Apple App Store using Apple's StoreKit. The current product identifiers are:
pub.beisl.app.premium.annual— annual auto-renewing subscription, andpub.beisl.app.premium.monthly— monthly auto-renewing subscription.
The price displayed in the app at the moment of purchase, in your local currency and including any applicable taxes, is the price you pay. Apple sets the price in each store after taking the developer's tier into account.
7.2 What Premium unlocks
Beisl Premium currently includes:
- larger crews (free accounts can have up to 4 friends in a crawl; Premium removes that cap, subject to reasonable abuse limits we may impose), and
- multiple custom bar lists.
We may add, remove, or change Premium features over time. We will not materially reduce the value of an active Premium subscription without giving you reasonable notice and, where required by law, the opportunity to terminate and obtain a refund of the unused portion.
7.3 Renewal, cancellation, and refunds
Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the period. To cancel, open Settings → [your name] → Subscriptions on your iOS device and turn off auto-renewal. Cancelling stops future billing; access continues until the end of the current paid period.
Refunds for App Store purchases are handled by Apple, not by Beisl. You can request a refund through Apple at reportaproblem.apple.com. We do not have direct access to your payment instrument and cannot issue refunds ourselves.
If you have a statutory right of withdrawal (for example, the 14-day right under EU Directive 2011/83/EU on consumer rights), you can exercise it by following Apple's refund process; by starting a digital subscription you expressly request that we begin performance immediately and acknowledge that you will lose your right of withdrawal once delivery of the digital content has begun, except where the law of your country provides otherwise (in particular, the German Bundesgerichtshof has held that this loss only takes effect if the trader confirms it; we do so confirm).
7.4 Failure to pay
If a renewal payment fails, Apple may attempt to retry the charge; if it remains unpaid, your subscription will end at the close of your current paid period and your account will revert to the free tier. Premium features will be locked.
7.5 Family Sharing
We may, at our discretion, enable Family Sharing for Beisl Premium. Where enabled, Premium status is shared among the members of an Apple Family group as Apple defines that feature. We do not control which Apple Family you are part of.
8. Privacy and location
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. In particular:
- We collect and process precise location data while a crawl is active, using on-device geofences and (only if you turn on the per-crawl “Share location” switch) live position broadcasts to other crew members. Live position points are deleted from our servers within approximately 60 seconds. You can withdraw consent for location sharing at any time by toggling the switch off, or by revoking the iOS Location permission in Settings → Privacy & Security.
- We use Apple Push Notification service to deliver notifications. You can disable notifications in iOS Settings.
- We use Sign in with Apple to authenticate you. We never store your email address.
By using location-based features and notifications, you consent to the corresponding processing as described in the Privacy Policy.
9. Acknowledgement of risks (please read)
Beisl is a social app about going to bars, where alcohol is typically consumed. You acknowledge and agree that:
- You are solely responsible for your decisions and conduct in the real world, including how much you drink, whether you drive, how you get home, how you behave towards bar staff and other patrons, and how you treat the people in your crew.
- Beisl is not a substitute for situational awareness. Geofences may be inaccurate, GPS may drift, push notifications may be delayed or undelivered, and other crew members may go offline. You must not rely on the live-position map or arrival prompts in any situation where a navigation, safety, or transport decision matters.
- The Service is not designed for emergency response. It is not a replacement for the emergency services in your country (e.g. 112 in the EU, 911 in the US, 000 in Australia). Do not rely on Beisl to summon help.
- Bar information is user-generated. A bar entry in Beisl may be inaccurate, out of date, no longer in business, in a different location than indicated, or operated by people other than those described. Verify before relying.
- Drink responsibly. Do not drink and drive. Look out for the people you go out with.
By using the Service you accept these realities and agree that we are not liable for them, except as set out in Section 11.
10. Intellectual property
Beisl, the Beisl word mark and logo, the Service, the iOS app, the website, the API, and all software, design, copy, layout, graphics, and other materials we create are owned by Timmo Caspar Achsel and are protected by copyright, trademark, and other intellectual-property laws.
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Beisl iOS app on a device you own or control, and to access the Service, solely for your personal, non-commercial use, and subject to these Terms (and, for the iOS app, the Apple EULA).
Except for that licence, we do not grant you any right in the Service. You will not (and will not allow a third party to): (a) sell, lease, sublicense, or otherwise commercialise the Service or any part of it; (b) modify, translate, adapt, or create derivative works of the Service; (c) decompile, disassemble, reverse-engineer, or otherwise attempt to derive the source code of the Service, except to the limited extent that applicable law expressly permits, and only after first asking us in writing whether we can provide the information you need; (d) remove or alter any copyright, trademark, or other proprietary notice; or (e) use the Service to build a competing product.
We welcome feedback. If you choose to send us suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use that feedback for any purpose, without compensation or attribution.
11. Disclaimers and limitation of liability
11.1 Disclaimers
Within the limits permitted by law:
- The Service is provided “as is” and “as available”, without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy, completeness, or non-infringement, and any warranty arising out of a course of dealing or usage of trade.
- We do not warrant that the Service will be uninterrupted, error-free, secure, free from viruses or other harmful components, that defects will be corrected, that any data will be preserved, or that any specific result will be achieved.
- Bar information, friend information, ratings, location data, and event timing inside the Service are provided for convenience only. We do not guarantee their accuracy, completeness, or timeliness.
11.2 Statutory rights of consumers
If you are a consumer (a natural person acting outside your trade, business, or profession), some of the disclaimers and limitations in this Section 11 may not apply to you in full because mandatory consumer-protection law in your jurisdiction grants you rights that cannot be waived. Nothing in these Terms affects those mandatory rights. In particular, EU and EEA consumers retain the rights granted by Directive (EU) 2019/770 on the supply of digital content and digital services and Directive 2011/83/EU on consumer rights; UK consumers retain the rights granted by the Consumer Rights Act 2015; California residents retain the rights granted by the Song-Beverly Consumer Warranty Act; and equivalent statutes in other jurisdictions continue to apply.
11.3 Limitation of liability
To the maximum extent permitted by law, Beisl will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, revenue, business, opportunity, goodwill, anticipated savings, or data, arising out of or in connection with the Service, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the maximum extent permitted by law, Beisl's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Service in any 12-month period will not exceed the greater of (a) the total amount you paid Beisl through the App Store in that period, or (b) twenty euro (€20).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence and intentional misconduct.
11.4 Indemnification
If you are not a consumer, you agree to defend, indemnify, and hold harmless Beisl, its successors, and its personnel from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or relating to (i) your use of the Service, (ii) your User Content, (iii) your violation of these Terms or applicable law, or (iv) your violation of any right of a third party.
12. Suspension, termination, and survival
12.1 Termination by you
You can stop using the Service at any time. To delete your account, open Profile → Account → Delete Account in the iOS app; this triggers the deletion process described in Section 9 of the Privacy Policy. To cancel a Premium subscription, follow the steps in Section 7.3 above.
12.2 Termination or suspension by us
We may suspend or terminate your access to all or part of the Service, with or without notice, if:
- you breach these Terms or any law;
- we reasonably believe your continued use poses a risk to other users, to the Service, or to us;
- we are required to do so by law, by a court order, or by Apple's policies;
- your account has been inactive for an extended period (we will give you reasonable notice); or
- we discontinue the Service or any feature, in whole or in part.
If we terminate your account for cause, we may retain limited information necessary to enforce these Terms, prevent abuse, and comply with law.
12.3 Effect of termination
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Sections 6.2, 7.3, 9, 10, 11, 12.3, 13, and 15) will survive.
13. Governing law and dispute resolution
13.1 Governing law
These Terms, and any dispute arising out of or relating to them or to the Service, are governed by the laws of Sweden, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
13.2 Consumers in the EEA, UK, and Switzerland
If you are a consumer habitually resident in the European Economic Area, the United Kingdom, or Switzerland, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence. You may bring proceedings against us in the courts of Sweden or in the courts of your country of residence, whichever you prefer; we may bring proceedings against you only in the courts of your country of residence.
13.3 Other users
If you are not a consumer, the courts of Stockholm, Sweden have exclusive jurisdiction over any dispute arising out of or relating to these Terms, and you submit to that jurisdiction.
13.4 EU online dispute resolution
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr/. We are not obliged to participate in alternative dispute resolution and currently choose not to. You can always contact us at hello@beisl.pub and we will try to resolve your complaint informally.
13.5 Time limit on claims
To the maximum extent permitted by law, any claim arising out of or relating to these Terms or the Service must be filed within one year after the cause of action arose, or it is permanently barred. This Section 13.5 does not apply to consumers where the law of the consumer's residence gives a longer mandatory limitation period.
14. App Store specific terms
These Terms are between you and Beisl. Apple is not a party to them. The following provisions apply because you obtained the Beisl iOS app through the Apple App Store, and they prevail over any conflicting term elsewhere in these Terms or in the Apple EULA:
- Acknowledgement. Apple is not responsible for the Service or its content. The Apple EULA between you and Apple is between you and Apple only; these Terms supplement, and where stricter, replace it.
- Scope of licence. The licence granted to you in Section 10 is limited to a non-transferable licence to use the iOS app on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the iOS app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. Beisl is solely responsible for providing maintenance and support services for the iOS app. Apple has no obligation whatsoever to furnish any maintenance or support services.
- Warranty. Beisl is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the iOS app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the iOS app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the iOS app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are Beisl's sole responsibility.
- Product claims. Beisl, not Apple, is responsible for addressing any claims by you or a third party relating to the iOS app or your possession or use of the iOS app, including (a) product-liability claims; (b) any claim that the iOS app fails to conform to applicable legal or regulatory requirements; and (c) claims arising under consumer-protection, privacy, or similar legislation.
- Intellectual-property claims. In the event of a third-party claim that the iOS app or your possession and use of it infringes that third party's intellectual-property rights, Beisl, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of the claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. You and Beisl acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
15. General
15.1 Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Beisl with respect to the Service and supersede any prior or contemporaneous communications, proposals, or agreements between us on the subject. Any additional or different terms in any purchase order, confirmation, or similar document you send us are rejected.
15.2 Amendments
We may modify these Terms from time to time. If we make material changes, we will provide reasonable notice — for example, by posting the updated Terms at the same URL where you found this version, by updating the “Last updated” date, and, for changes that affect your rights, by showing an in-app notice or sending you a push notification. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes. If you do not agree, your remedy is to stop using the Service and, if you wish, to delete your account.
15.3 No waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
15.4 Severability
If any provision of these Terms is held by a court of competent jurisdiction to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent, or, if it cannot be so modified, severed; the remaining provisions will remain in full force and effect.
15.5 Assignment
You may not assign or transfer these Terms or any of your rights or obligations under them, in whole or in part, without our prior written consent. We may assign these Terms in whole or in part to any successor entity, or to a buyer of all or substantially all of the assets to which the Service relates, without your consent and without notice; in that case the Privacy Policy continues to apply.
15.6 Force majeure
Beisl is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, flood, accidents, strikes, network or power failures, or third-party-service outages (including Apple infrastructure or our hosting provider).
15.7 Notices
We may give you notices through the iOS app, by email if you have provided one when contacting us, or by posting on the Beisl website. You must give us notices by emailing hello@beisl.pub.
15.8 Language
These Terms were prepared in English. If we provide a translation, the English version controls in case of any conflict, except where the law of your country requires that a local-language version govern.
